Terms of Service

Effective date: July 17, 2026

These Terms of Service ("Terms") govern your use of the cloudsoe.com website and the software images, documentation, and related materials (collectively, the "Products") that CloudSOE ("we", "us", or "our") makes available, including through the AWS Marketplace and Azure Marketplace. By accessing this site or deploying any of our Products, you agree to these Terms.

1. The Products

CloudSOE publishes pre-configured machine images and related software for deployment on cloud platforms. Marketplace purchases are additionally governed by the terms of the marketplace through which you obtain the Product (AWS Marketplace or Azure Marketplace) and the license terms of any open-source components included in an image.

2. Acceptable Use

You may use the Products only in compliance with applicable laws and regulations. You agree not to use the Products to infringe the rights of others, to distribute malware, or to engage in any unlawful activity. You are responsible for securing and maintaining the environments into which you deploy our images, including applying updates and configuring access controls appropriate to your workload.

3. Third-Party and Open-Source Software

Our images may include third-party and open-source software, each governed by its own license. Nothing in these Terms limits or replaces the rights and obligations you have under those licenses.

4. Disclaimer of Warranties

THE PRODUCTS AND THIS WEBSITE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PRODUCTS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VULNERABILITIES, OR THAT THEY WILL MEET YOUR REQUIREMENTS.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLOUDSOE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PRODUCTS OR THIS WEBSITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

6. Your Responsibility

You are solely responsible for evaluating whether a Product is appropriate for your use case, for testing it before production use, and for the operation, backup, and security of your own deployments and data.

7. Support

Support is provided on a reasonable-efforts basis through the channels listed on our Support page, unless a separate written agreement provides otherwise.

8. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the site or Products after changes take effect constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions.
